Terms of Use
Effective and last updated: October 16, 2026
Desert Oasis Insider helps readers explore the Coachella Valley and surrounding mountain towns through original reporting, photography, AI-generated illustrations, guides, interactive tools, and the My DOI personal dashboard. These Terms of Use explain how you may use that work, how to interpret our imagery, and how website information relates to Mark’s real-estate work.
These Terms of Use, also called our Terms of Service or “Terms,” govern use of desertoasisinsider.shop and its website features. “We,” “us,” and “our” mean Mark Miller operating Desert Oasis Insider. If you do not agree with these Terms, please discontinue use. Where a feature or applicable law requires affirmative agreement, the acceptance process for that feature applies.
The essentials
- Explore and share links: you are welcome to read our reporting and link others to it. Republishing our photos, videos, or substantial written content requires permission unless the law allows the use.
- Verify before acting: market data, floor plans, community costs, maps, and interactive estimates have limits and can change.
- Real-estate representation requires its own arrangements: reading, searching, or submitting an inquiry does not by itself create a brokerage relationship or an obligation to pay a commission.
- Our imagery includes AI: alongside Mark’s original photography, we use AI-generated and AI-assisted images for storytelling, illustration, and other creative purposes. These images may depict imagined or reconstructed scenes.
- Your My DOI content stays yours: private photo uploads are for your account, with a limited permission to process and display them for the service. Saved-page alerts and the newsletter have separate controls.
- Privacy is explained separately: our Privacy Policy describes information collection and your choices. These Terms do not supply consent for every form of tracking or marketing.
1. The website and its purpose
Desert Oasis Insider is an independent local publication and media business. It covers places, communities, people, history, nature, activities, local services, and real estate. Articles can include reporting, opinions, firsthand observations, public-source research, and third-party information. Our approach to sourcing, disclosures, and corrections is explained in our Editorial Standards.
Many pages are informational guides even when Shopify organizes them as “products” or “collections.” A page about a home, floor plan, community, business, or attraction is not itself an offer by us to sell that property, admission, membership, or third-party service. Desert Oasis Insider no longer offers real-estate photography or other photography, video-production, YouTube-management, or marketing services to clients. Coverage of a local business does not mean we provide services for that business.
2. Articles, photography, video and permitted use
Our original articles, photographs, videos, graphics, page designs, and original tools are owned by Mark Miller/Desert Oasis Insider or used with permission, except where another owner or source is identified. Third-party photographs, builder floor plans, maps, MLS information, names, logos, and other material remain subject to their owners’ rights. We do not claim ownership of facts or third-party material. Rights in AI-assisted material extend only to elements protected under applicable law; we do not claim copyright in purely AI-generated elements.
You may read the website for personal use, share links, and use any download or sharing feature according to the instructions provided. Copyright exceptions, including fair use where applicable, remain available. Attribution alone does not grant a license to republish a photograph or substantial article text.
Unless a specific license or applicable law permits it, obtain written permission before reproducing or republishing our articles, photographs, or videos; using our work in listings, advertising, or paid products; distributing copies; removing watermarks or credits; or systematically copying or compiling our content into another publication, database, or commercial service.
Being a subject of an article, owning a featured property, or being a client does not by itself transfer copyright. For permission requests, contact MarkMillerCA@gmail.com with the material, proposed use, and where it would appear.
3. Accuracy and changing information
We work to provide useful, accurate reporting and correct errors brought to our attention. Information reflects its source and stated reporting period. A page’s update date does not necessarily mean every figure, quotation, image, or external link was independently reverified on that date.
Prices, HOA dues, assessments, membership charges, availability, opening hours, access rules, construction schedules, amenities, rental restrictions, and laws can change. Statements about plans or proposed developments are not guarantees of approval, completion, timing, or final features. Documentary photographs show conditions when taken and can include models, staging, optional upgrades, or historical conditions. AI-generated images, digitally altered scenes, and conceptual illustrations may not depict actual or current conditions; see AI-generated images and visual storytelling below.
Before making a financial, property, travel, or activity decision, confirm material details with the appropriate current source—such as a property owner, builder, HOA, club, operator, government agency, or your professional adviser. Contact us with a specific correction and supporting information.
4. Interactive tools, maps and floor plans
Calculators, market explorers, filters, comparisons, maps, and floor-plan tools are for general exploration. Their results depend on the data, assumptions, filters, reporting dates, and inputs shown. An estimate is not an appraisal, lender quote, insurance quote, tax determination, legal opinion, or promise of a transaction outcome.
- Market data: samples may omit transactions or include classification differences. Past sales and selected comparables do not guarantee a particular property’s value, sale price, appreciation, or time on market.
- Cost estimates: calculators may exclude assessments, insurance changes, taxes, financing costs, maintenance, membership fees, and other expenses. Obtain property-specific figures before committing.
- Floor plans and measurements: plans are illustrative and can vary by builder, model, elevation, lot, construction phase, option, or later alteration. Dimensions and square footage require independent verification. Plans are not construction documents, surveys, engineering advice, or a certification of permitted work.
- Maps and route information: location markers and routes can be approximate. They do not establish boundaries, easements, legal access, trail conditions, or permission to enter property.
5. Real-estate information and inquiries
Mark Miller is a California real-estate agent, DRE #01963114. Mark also owns Bloom Home Search Engine. The website can help readers research communities and contact Mark about buying, selling, or renting. Current brokerage disclosures appear on the website and applicable transaction documents.
Reading an article, using a search tool, or sending an inquiry does not by itself establish representation, fiduciary duties, an exclusive agency relationship, or an obligation to pay a commission. Representation, duties, scope, and compensation are governed by applicable law and the relevant agreements. Nothing in these Terms waives a duty that applies when Mark acts as your agent.
General website information does not replace individualized real-estate, legal, tax, lending, insurance, inspection, or other professional advice. Community descriptions and comparison tools support your own research and preferences. Housing services remain subject to applicable fair-housing and nondiscrimination requirements.
MLS and other listing information is subject to the source’s notices and usage restrictions, including any personal, noncommercial-use limitations shown with the data. A search result or a property featured in our reporting is not a guarantee that it is currently available.
You remain free to select the professionals you use. See our Editorial Standards for ownership, professional-role, and editorial disclosures.
6. Third-party businesses, links and activities
We may describe or link to businesses, communities, clubs, trails, attractions, software, videos, maps, or other third-party resources. A mention, interview, review, or link does not make us the operator of that business or activity and does not guarantee its safety, quality, availability, or performance. A mention also does not, by itself, establish a partnership, agency, or service relationship.
When you use another provider’s site, book a service, join a club, or enter an activity, that provider’s agreement, privacy notice, qualifications, and operating rules also apply. Confirm pricing, permissions, eligibility, access, cancellation rules, and other material conditions directly with the provider.
Outdoor and recreational information cannot account for your experience, fitness, weather, heat, wildlife, water conditions, closures, or conditions on a particular day. Check current official guidance and on-site restrictions. A map, photograph, or article is not permission to enter private or closed property.
7. AI-generated images and visual storytelling
Desert Oasis Insider uses both original photography by Mark Miller and images created or modified with artificial intelligence. AI-generated and AI-assisted visuals are used for storytelling, educational illustration, historical interpretation, conceptual scenes, and other creative purposes across the website. References to our original photography do not mean that every image on the website was captured with a camera.
AI visuals may look photographic while depicting imagined people, places, objects, or events, or combining real and generated elements. They may contain inaccuracies or creative interpretations. A historical illustration is not an archival photograph or proof that a scene occurred exactly as shown. A conceptual image of a community or development is not an official plan, a builder-approved rendering, or a promise of completed features unless expressly identified and supported as such.
Do not rely on an AI-generated or materially altered image to establish a property’s actual appearance, condition, boundaries, views, amenities, or construction status. Confirm those details through current property information, official sources, and an in-person inspection where appropriate.
Captions, credits, and nearby notes may provide additional context about an image’s source or purpose. If the origin or meaning of an image is unclear, contact us with the page link. This general disclosure does not replace any image-specific labeling or disclosure required by applicable law or real-estate advertising rules.
8. Submissions, accounts and respectful use
Provide accurate information, act only for yourself or someone you are authorized to represent, and submit only material you have a right to provide. Do not use the website to impersonate others, harass people, send spam, publish unlawful material, infringe rights, collect other visitors’ information without authorization, introduce malicious code, bypass access restrictions, or disrupt the service.
If you intentionally submit material for public display, such as a public comment or review, you retain your rights and authorize us to display and make reasonable formatting or moderation changes needed to use that submission for its stated purpose. Separate publication or licensing arrangements may apply to contributed photographs, stories, interviews, or commissioned work. Sending a private inquiry does not automatically authorize its use as a public endorsement.
We may remove or restrict public submissions that are unlawful, misleading, abusive, infringing, off-topic, or inconsistent with the feature’s rules. We may restrict access when reasonably necessary to address misuse or protect the website, subject to applicable law.
If you use an account, protect its credentials and contact the relevant provider about suspected unauthorized use. Our inquiry, account, and newsletter features are intended for adults able to enter the relevant arrangement.
My DOI accounts and saved information
My DOI uses Shopify sign-in for saved resources, folders, trips, following, viewing history, recommendations, personal notes, nature records and private photos. Use the service only for an account you control or are authorized to manage. Information deliberately saved to the account can sync across devices; browser drafts and local preferences are separate. Signing out or clearing browser storage does not delete account information. The Privacy Policy explains storage, owner reporting, export and removal controls.
Recommendations, trip plans, maps and nature records help you organize your own research. They do not verify a sighting, certify identification, establish permission to enter property, reserve access, or guarantee opening hours, safety, availability or suitability. Check current operators and official sources before acting.
Your private photos and upload permissions
You retain the rights you hold in photos, notes and other material you add to My DOI. Upload only material you have permission to use, and respect other people’s privacy. Avoid sensitive documents and unnecessary identifying or location information. Storage, format, size and activity limits can apply as shown in the feature.
By uploading private account content, you give Desert Oasis Insider and the service providers operating My DOI a limited, nonexclusive permission to receive, store, copy, resize, re-encode and display that content as needed to provide, secure and support the feature for you. This does not transfer ownership or authorize public editorial publication or advertising use. Public My DOI photo sharing is currently paused. Any later intentional public submission or separately agreed publication would have its own stated permissions.
Uploaded photos are processed copies, with resizing and embedded metadata removal; retain your original files elsewhere. My DOI is not an archival backup service. Use available photo-deletion controls, or contact Mark for removal not offered in the interface, including removing a profile image without replacing it. Removing a nature record removes photos still attached to it; removing a photo collection removes its organization rather than the underlying photos. Account-data exports contain structured records and photo information, not the image files themselves. File cleanup, backups and necessary retention are explained in the Privacy Policy. Contact Mark for help with access or account-data deletion.
Shared-trip links
A shared-trip link contains an encoded snapshot of the itinerary. Anyone with the link can open and forward it without signing in. It does not open your account or share your private photos or notes. Editing or deleting the saved trip does not revise or revoke a previously shared link or another person’s copy. Include only information you intend to share, and check the itinerary before sending it.
9. Privacy and communications
Our Privacy Policy explains how information is collected, used, and disclosed through the website, including forms, analytics, advertising, and embedded services. It also explains privacy choices and how to contact us with a request.
My DOI updates: bookmarks, follows and email delivery are separate choices. Saving a bookmark in the current interface does not itself subscribe you to email. Following a page or area adds matching coverage to your on-site Updates feed; use the separate email choice for daily or weekly delivery. Existing subscriptions and off preferences are preserved when moving from the earlier saved-page model. Delivery requires an available service, a confirmed address and new matching coverage. Turn email off in My DOI’s Email settings or use an update email’s unsubscribe process. Newsletter subscriptions have their own unsubscribe link. Stopping either subscription does not automatically stop the other, delete your bookmarks, or prevent necessary account notices and service responses.
Alerts depend on our editorial update process, matching rules and email delivery. Following a page does not guarantee an email for every edit, delivery at a particular time, or notification of every change affecting a place or project. Verify current information directly when timing matters.
We may respond to an inquiry through the contact details you provide. Newsletter subscriptions and other marketing choices are handled through their own signup and unsubscribe processes. These Terms do not replace any legally required consent for marketing calls, texts, cookies, or other processing.
10. Availability, warranties and responsibility
We may update, reorganize, or discontinue free website features and cannot promise uninterrupted availability, error-free operation, or that all external information and links will remain current. Subject to applicable law, the free website and general informational tools are provided “as is” and “as available,” without additional warranties of accuracy, completeness, fitness for a particular purpose, or uninterrupted operation.
To the extent permitted by applicable law, we are not responsible for indirect, incidental, special, or consequential losses arising from use of the free website or reliance on general informational content. Mark’s responsibilities when providing real-estate representation remain governed by the applicable agreements and law.
Your legal rights remain intact. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, gross negligence where exclusion is prohibited, or violations of nonwaivable consumer or professional duties. Nothing prevents lawful reviews, complaints, reports to regulators, or remedies available under applicable law.
11. Applicable law and existing agreements
These Terms are governed by California law and applicable federal law, without depriving you of mandatory protections that apply in another jurisdiction. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
These Terms address general website use. A separately accepted brokerage, licensing, or other existing agreement continues to control its own subject matter where the documents conflict. The Privacy Policy controls the description of our personal-information practices. These Terms do not impose a separate mandatory-arbitration agreement or class-action waiver.
12. Updates to these Terms and My DOI
We may revise these Terms as the website or our work changes. Revisions are posted here with an updated effective date. My DOI’s Account updates log describes meaningful account improvements, and we may show a notice on your next signed-in visit. Routine feature notices do not require a new agreement each time.
When a particular change requires acceptance or permission under applicable law, we will request it separately and explain what the choice covers. An acknowledgment of an update is not permission for optional tracking, marketing, or disclosure of private account content. Resource-activity sharing has its own choice and can be turned off in My DOI.
Changes apply prospectively. They do not retroactively rewrite an existing service agreement, expand an earlier privacy permission, remove accrued rights, or override nonwaivable legal protections.
13. Contact, corrections and permissions
Contact us with a question about these Terms, a factual correction, a content-permission request, or a concern about material on the website. Identify the relevant page and explain the request so we can review it.
